Another Win for Our Stuart Office!

Attorney, Jessica VanValkenburgh defended a client in a Mortgage Foreclosure case in Martin County recently.

Trial was originally set for September of 2014 wherein the Magistrate recommended judgment for the Plaintiff.  Jessica filed Exceptions which were granted by the Senior Judge, ultimately resetting Trial for this week, during which, Jessica fought diligently to keep out an undisclosed and improperly qualified translator witness as well as hearsay Certificate of Accuracy.


It was also revealed during this week's Trial that the demand letter was only sent to the client in Spanish.  Without an English version or proper translation of said letter, the Judge was unable to determine that a proper default letter was sent in accordance with the Mortgage regulations, leading to a favorable result for our client.


After 6 hours of deliberations, the Senior Judge granted Jessica's Motion for Involuntary Dismissal.  Great Work, Jessica!
