What are the required steps to terminate a trust?
It first depends on whether the trust is irrevocable or revocable. Typically, it will say on the first page of the trust instrument.
Do you know whether your trust was revocable or irrevocable? If the trust was irrevocable, then it can’t be terminated.
If it is revocable, then the trustee would need to execute a document terminating the trust. It should be notarized and witnessed. Typically, the trust document itself will explain what needs to be done to terminate the trust.
