If adjudication was with held is it still a conviction? In a background check will it show a conviction?
A withhold of adjudication is not a conviction. The individual has not been “convicted,” because the conviction has been “withheld” so he or she can ethically respond “no” to any question related to conviction on a job application. However, if the record was never sealed or expunged the background check will show you were charged or arrested but the adjudication was withheld. We hope this basic description of the law in this situation adds to your understanding and wish you well.
