Can a landlord keep my deposit?

Posted By: Ejola Cook

Q

I rented a house with 3 roommates in Palm Beach County, Florida and we each gave $375 deposit totaling $1500. I moved out and the lease was up 1/31/14. The other 3 signed new lease, but the owner of the house wont give me my share of deposit back. They state that I have to get it back from the other 3 roommates. Is that true?

A

Your Landlord might be right.  It depends on how you signed the lease and whether the original lease was renewed or if the remaining roommates signed a new lease.

If they signed a new lease, you have no obligation to the Landlord and it might trigger the notice requirement for him to keep the funds.
