Are Federal default judgements like civil commodities, futures trading commission “CFTC” dischargeable in personal Chapter 7 Bankruptcy ? I am 58 recently disabled by social security and on Feb 1st, CFTC “Treasury Offset Program” garnished -15% or $336 from my disability despite my appeal to contest being fully disabled.
CFTC judgement said to send copy of my Chapter 7 to verify I have No Assets, No job and life threatening illness requiring major surgery…They don’t seem to care…Can you help me ?
I am sorry about what you are going through. I am going to do my best to help you with this issue.
In all likelihood, this judgment could be discharged through a Chapter 7 Bankruptcy. There are only a handful of things that a Chapter 7 cannot help with, but a Federal Judgment is not necessarily one of them. I would like to review the judgment and ascertain with certainty if this will be dischargeable. We offer free initial consultations, so it won’t cost you a dime to take a look at your documents. If you could respond back providing me a copy of the judgment, I can take a look and get back to you. Hopefully we will be able to help you with your situation, so you will not have to worry about this going forward.
