You’ve just been in a car accident. What should you do?
The best practice is to contact a personal injury attorney right away. This will help determine whether you have any claim or right to receive compensation from the party that injured you.
But, what if you didn’t know, or just chose not to contact an attorney? We understand that having an accident can often be a traumatic experience. Not everyone speaks to an attorney right away.
Here’s the good news: there may still be time to file a lawsuit seeking reimbursement for your injuries.
Personal Injury Lawsuit Deadlines Vary By State.
Every state has laws that provide a time limit for an individual to file a lawsuit on each particular cause of action. That is the statute of limitations.
For instance, the statute of limitations to sue on a contract in Florida is five years. Some contract claims have a shorter statute of limitations, but the general time limit for contracts lawsuits is five years.
Personal Injuries in Florida have a similar time limit to file a lawsuit. The statute of limitations for an injury in Florida is four years from the date of the accident.
In other words, a plaintiff or the injured party has four years from the date of their accident to negotiate settlement and to ultimately file a complaint in court against the party that injured them. If that party waits more than four years, then their lawsuit will be barred by the statute of limitations.
In very limited circumstances, the statute of limitations may be extended beyond four years. This can occur when a plaintiff did not reasonably discover their injuries until a date after the accident. In this case, the lawsuit window would be extended using the date of reasonable discovery.
